Le candidat r\u00e9pond \u00e0 des questions pr\u00e9enregistr\u00e9es par le recruteur avec une vid\u00e9o.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Ces enregistrements sont ensuite analys\u00e9s par une IA \u00e0 l\u2019aide d\u2019algorithmes d\u2019\u00e9valuation pr\u00e9d\u00e9finis. Les activit\u00e9s telles que la s\u00e9lection de candidatures, le tri de CV, la conduite d\u2019entretiens automatis\u00e9s ou encore les d\u00e9cisions de promotion et de gestion du personnel rel\u00e8vent de cette cat\u00e9gorie.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u00c0 partir du 2 ao\u00fbt 2026, plusieurs types de syst\u00e8mes d\u2019IA utilis\u00e9s dans le recrutement feront l\u2019objet de restrictions et d\u2019obligations renforc\u00e9es, notamment :<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les syst\u00e8mes d\u2019IA destin\u00e9s au recrutement ou \u00e0 la s\u00e9lection de personnes physiques, y compris la publication d\u2019offres cibl\u00e9es, l\u2019analyse et le filtrage des candidatures, ou l\u2019\u00e9valuation des candidats ;<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les syst\u00e8mes d\u2019IA utilis\u00e9s pour prendre des d\u00e9cisions relatives aux conditions de travail, \u00e0 la promotion, \u00e0 la r\u00e9siliation de contrat, ou pour attribuer des t\u00e2ches en fonction du comportement ou des caract\u00e9ristiques personnelles ;<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les syst\u00e8mes servant \u00e0 surveiller ou \u00e9valuer les performances et le comportement des travailleurs dans le cadre de leur activit\u00e9 professionnelle.<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">En d\u2019autres termes, toutes les entreprises qui utilisent l\u2019IA pour des t\u00e2ches telles que le parsing, le scoring, le matching, ou la pr\u00e9qualification de candidatures sont d\u00e9sormais consid\u00e9r\u00e9es comme utilisatrices d\u2019IA \u00e0 haut risque. <\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Les acteurs du recrutement doivent d\u00e8s \u00e0 pr\u00e9sent anticiper ces \u00e9volutions r\u00e9glementaires et int\u00e9grer des mesures de gestion et de compensation des risques.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Cela implique notamment :<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">une \u00e9valuation de conformit\u00e9 des outils utilis\u00e9s ;<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la mise en place de proc\u00e9dures de transparence envers les candidats (explication du r\u00f4le de l\u2019IA dans les d\u00e9cisions) ;<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">et la supervision syst\u00e9matique par un \u00eatre humain des d\u00e9cisions automatis\u00e9es.<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">L\u2019objectif de l\u2019IA Act n\u2019est pas de freiner l\u2019innovation, mais de garantir une utilisation responsable, transparente et \u00e9thique de l\u2019intelligence artificielle dans les pratiques de recrutement.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2676c37 e-flex e-con-boxed e-con e-parent\" documentation d\u00e9taill\u00e9e fournissant toutes les informations n\u00e9cessaires sur le syst\u00e8me et son objectif pour permettre aux autorit\u00e9s d\u2019\u00e9valuer sa conformit\u00e9\u00a0<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 400;\">Des informations claires et ad\u00e9quates \u00e0 l\u2019intention du d\u00e9ployeur\u00a0<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 400;\">Des mesures de surveillance humaine appropri\u00e9es<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 400;\">Un niveau \u00e9lev\u00e9 de robustesse, de cybers\u00e9curit\u00e9 et de pr\u00e9cision<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div exigences de l\u2019IA Act, les organisations utilisant des syst\u00e8mes d\u2019intelligence artificielle \u00e0 haut risque, notamment dans le domaine du recrutement, doivent mettre en place un ensemble de mesures techniques et organisationnelles visant \u00e0 garantir la s\u00e9curit\u00e9, la transparence et la conformit\u00e9 juridique de leurs outils.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Le non-respect de ces obligations peut entra\u00eener des sanctions particuli\u00e8rement s\u00e9v\u00e8res.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Les pratiques non conformes li\u00e9es \u00e0 l\u2019utilisation d\u2019IA \u00e0 haut risque sont passibles d\u2019amendes pouvant atteindre :<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">jusqu\u2019\u00e0 <strong>15 millions<\/strong> d\u2019euros ;<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">jusqu\u2019\u00e0 <strong>3 % du chiffre d\u2019affaires<\/strong> annuel mondial de l\u2019entreprise, selon le montant le plus \u00e9lev\u00e9.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Ces sanctions seront applicables \u00e0 compter du 2 ao\u00fbt 2027, date d\u2019entr\u00e9e en vigueur compl\u00e8te des dispositions relatives aux syst\u00e8mes \u00e0 haut risque.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">L\u2019automatisation du recrutement par l\u2019intelligence artificielle reste un outil \u00e0 double tranchant. <\/span><span style=\"font-weight: 400;\">Si elle permet un gain d\u2019efficacit\u00e9 et une meilleure gestion des candidatures, elle impose, en contrepartie, une grande rigueur \u00e9thique et juridique.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Les organisations doivent veiller \u00e0 ne pas se reposer enti\u00e8rement sur l\u2019IA, au risque d\u2019exclure des talents ou de porter atteinte \u00e0 l\u2019\u00e9quit\u00e9 du processus. Il est donc indispensable de pr\u00e9server une <\/span><a href=\"https:\/\/www.ia-info.fr\/recrutement-8-drh-sur-10-ont-deja-adopt-l-ia.html\"><span style=\"font-weight: 400;\">intervention
