Toutefois, le recruteur doit se montrer transparent en informant son candidat sur la mise en \u0153uvre des m\u00e9thodes et techniques d\u2019aide au recrutement utilis\u00e9es \u00e0 son \u00e9gard. \u00c0 ce titre, le recruteur doit recueillir le consentement du candidat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La fa\u00e7on d\u2019informer le candidat n\u2019\u00e9tant pas r\u00e9gie par la loi, le recruteur se retrouve libre de communiquer les tenants et aboutissants des tests de s\u00e9lection comme il le souhaite. Ainsi, il peut mentionner les informations relatives aux tests de s\u00e9lection dans l\u2019annonce de son offre d\u2019emploi, dans son mail de convocation ou juste avant l\u2019entretien.<\/span><\/p>\n<p><a class=\"external\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900847\/2008-05-01\" target=\"_blank\" rel=\"noopener noreferrer\" data-vars-event-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900847\/2008-05-01\">Se r\u00e9f\u00e9rer \u00e0 l\u2019article L1221-8<\/a><\/p>\n<h3>Durant le test de recrutement<\/h3>\n<p><span style=\"font-weight: 400;\">L\u2019objectif d\u2019un test de recrutement consiste \u00e0 aider le recruteur dans sa d\u00e9cision d\u2019embauche, en lui fournissant des informations pertinentes sur la capacit\u00e9 du candidat \u00e0 occuper le poste en question et ses aptitudes professionnelles. Dans cette mesure, tout recueil d\u2019informations s\u2019\u00e9cartant de cet objectif est formellement proscrit. On ne pourra pas exiger d\u2019un comptable un niveau de gestion du stress comparable \u00e0 celui d\u2019un policier, et donc l\u2019\u00e9valuer sur une telle aptitude. Au-del\u00e0 du m\u00e9tier vis\u00e9, c\u2019est bien le caract\u00e8re professionnel des informations recueillies qui fait la r\u00e8gle. Les tests de s\u00e9lection doivent donc \u00e9valuer le candidat sur ses comp\u00e9tences m\u00e9tiers, ses comp\u00e9tences transversales (hard skills) ou ses qualit\u00e9s professionnelles (soft skills).<\/span><\/p>\n<p><a class=\"external\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900845\/2008-05-01\" target=\"_blank\" rel=\"noopener noreferrer\" data-vars-event-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900845\/2008-05-01\">Se r\u00e9f\u00e9rer \u00e0 l&rsquo;article L.1221-6 section 2<\/a><\/p>\n<h3>Apr\u00e8s le test de recrutement<\/h3>\n<p><span style=\"font-weight: 400;\">Selon les directives de la <a href=\"https:\/\/www.cnil.fr\/fr\/reglement-europeen-protection-donnees\" target=\"_blank\" rel=\"noopener noreferrer\">RGPD<\/a>, le recruteur est tenu de garder les r\u00e9sultats obtenus aux tests de s\u00e9lection confidentiels et d&rsquo;informer le candidat sur le traitement de ses informations et les personnes impliqu\u00e9es. N\u00e9anmoins, le recruteur doit pr\u00e9alablement avertir le candidat de la conservation de ses donn\u00e9es et recueillir son consentement. La dur\u00e9e de conservation des r\u00e9sultats des tests de s\u00e9lection ne devant pas exc\u00e9der deux ans, le recruteur doit, entre-temps, \u00eatre en mesure de restituer les r\u00e9sultats obtenus en bonne et due forme au candidat qui les r\u00e9clame.
